Law of the People's Republic of China on the Protection of the Disabled
Chapter I General Provisions
Article 1 [purpose and basis]
This law is formulated in accordance with the Constitution in order to safeguard the legitimate rights and interests of disabled persons, develop their undertakings, ensure their equal and full participation in social life and share the material and cultural achievements of society.
Article 2 [definitions; categories; standards]
Disabled persons refer to those who, in terms of psychology, physiology and human structure, have lost or abnormal some organization or function, or have lost all or part of their ability to engage in certain activities in a normal way.
Disabled persons include those with visual, hearing, speech, physical, intellectual, mental, multiple and other disabilities.
The disability standard shall be prescribed by the State Council.
Article 3 [protection of Rights]
Disabled people enjoy equal rights with other citizens in political, economic, cultural, social and family life.
The civil rights and human dignity of the disabled are protected by law.
It is prohibited to discriminate against, insult or infringe upon disabled persons. *
Article 4 [special assistance]
The State shall adopt auxiliary methods and supportive measures to give special assistance to disabled persons, reduce or eliminate the impact of disability and external obstacles, and ensure the realization of their rights.
Article 5 [special protection]
The state and society shall provide special security, preferential treatment and pension to disabled servicemen, disabled persons on duty and other disabled persons for the benefit of the state and the people.
Article 6 [duties of the government]
People's governments at all levels shall include undertakings for disabled persons in their national economic and social development plans, include funds in their financial budgets, make overall plans, strengthen leadership, coordinate comprehensively, and take measures to make undertakings for disabled persons develop in harmony with the economy and society.
The State Council and the people's governments of provinces, autonomous regions and municipalities directly under the central government shall take organizational measures to coordinate the development of the cause of disabled persons with the economy and society.
The State Council and the people's governments of provinces, autonomous regions and municipalities directly under the central government shall take organizational measures to coordinate the work of relevant departments in the cause of disabled persons. Specific institutions shall be prescribed by the State Council and the people's governments of provinces, autonomous regions and municipalities directly under the central government.
The relevant departments of the people's governments at all levels shall closely contact and listen to the opinions of the disabled, and do a good job in the work of the disabled in accordance with their respective duties.
Article 7 [Social Responsibility]
The whole society should carry forward the socialist humanitarian spirit, understand, respect, care for and help the disabled, and support the cause of the disabled.
Organs, organizations, enterprises, institutions and urban and rural grassroots organizations shall do a good job in the work of disabled persons within their respective areas.
State functionaries and other personnel engaged in the work of disabled persons shall perform their glorious duties and strive to serve disabled persons.
Article 8 [Responsibilities of disabled persons' Federation]
The Chinese Federation of disabled persons and its local organizations represent the common interests of disabled persons, safeguard their legitimate rights and interests, unite and educate them, and serve them.
The disabled persons' Federation undertakes the tasks entrusted by the government, carries out the work of disabled persons, mobilizes social forces and develops the cause of disabled persons.
Article 9 responsibilities of dependents, guardians and relatives
The legal supporter of a disabled person must perform the obligation to support the disabled person.
A guardian of a disabled person must perform his duty of guardianship and safeguard the lawful rights and interests of his ward.
Relatives and guardians of disabled persons shall encourage and help disabled persons to enhance their ability of self-reliance.
Maltreatment and abandonment of disabled persons is prohibited.
Article 10 [obligations of disabled persons]
Disabled people must abide by the law, fulfill their obligations, observe public order and respect social morality.
Disabled people should carry forward the optimistic and enterprising spirit, self-esteem, self-confidence, self-improvement and self-reliance, and contribute to the socialist construction.
Article 11 [disability prevention]
The State shall carry out the prevention of disabled persons in a planned way, strengthen the leadership of the prevention of disabled persons, publicize and popularize the knowledge of eugenics, eugenics and prevention of disabled persons, formulate laws and regulations, organize and mobilize social forces, and take measures to prevent the occurrence and development of disabled persons in light of genetics, diseases, drug poisoning, accidents, disasters, environmental pollution and other factors that cause disability.
Article 12 [awards]
For disabled persons who have made remarkable achievements in socialist construction, the government and relevant departments shall give rewards to units and individuals who have made remarkable achievements in safeguarding the legitimate rights and interests of disabled persons, developing undertakings for disabled persons and serving disabled persons.
Chapter II rehabilitation
Article 13 [duties]
The state and society shall take rehabilitation measures to help disabled persons recover or compensate their functions and enhance their ability to participate in social life.
Article 14 [guiding principles]
The rehabilitation work should proceed from the reality, combine the modern rehabilitation technology with the traditional rehabilitation technology of our country; take the rehabilitation institution as the backbone, the community rehabilitation as the foundation, the family of the disabled as the support; focus on the practical, easy and beneficial rehabilitation content, and carry out the research, development and application of the new rehabilitation technology, so as to provide effective rehabilitation services for the disabled.
Article 15 [organization and implementation]
In a planned way, the government and relevant departments set up rehabilitation medicine departments (rooms) in hospitals, set up necessary special rehabilitation institutions, and carry out rehabilitation medical treatment and training, scientific research, personnel training and technical guidance.
People's governments at all levels and relevant departments shall organize and guide urban and rural community service networks, medical, preventive and health care networks, organizations of disabled people, families of disabled people and other social forces to carry out community rehabilitation.
Educational institutions for the disabled, welfare enterprises and institutions, and other institutions serving the disabled shall create conditions and carry out rehabilitation training activities.
